GENERAL TERMS AND CONDITIONS OF SALE SUBSCRIPTIONS AND NON-SUBSCRIPTION TICKETS

The following is agreed between the SAS BLOCBUSTER simplified joint stock company and the customer.

1- SCOPE AND ACCEPTANCE

a/ These general terms and conditions, hereinafter referred to as the “GTCS”, apply to all sales and services concluded between the customer, who is not a professional, and SAS BLOCBUSTER, either in the form of a subscription (A/), or as part of free admission (B/). In the case of a subscription, the customer is referred to as “the subscriber”. In the case of free admission, the customer is referred to as “the customer”.

b/ They are governed by the Consumer Code, in particular Article L 111-1.

c/ The customer, subscriber or not, after having read these GCTS, declares that he/she/she accepts them without reservation; he/she acknowledges that they require compliance with the internal regulations of which he/she also declares that he/she is fully aware and of which he/she undertakes to comply scrupulously with the provisions.

A/ SUBSCRIPTION

2- DURATION

The subscription allowing the use of the room and, if applicable, the subscription allowing the attendance of the courses organised by SAS BLOCBUSTER are taken out for a fixed period of time. When it only concerns the use of the room, the subscription takes effect, as desired, for a period of three months or one year, from date to date, as soon as the subscriber has completed the registration form to which these GTC are attached, and paid the amount of the subscription for the chosen period. When the subscription allows the subscriber to follow the courses, these are given over the three periods whose duration is indicated below, without any possibility of adaptation other than that provided for by SAS BLOCBUSTER:

• from 1 September to 7 December

• from 8 December to 29 March of the following year

• from 30 March to 5 July

The subscription is then taken out for one of these periods, or for all three together, under the same conditions (registration form completed and payment made).

3- SERVICES AND TERMS OF USE OF THE ROOM

a/ For the duration of the subscription contract, apart from the courses and training sessions organised by SAS BLOCBUSTER, the subscriber may use the room’s facilities and benefit from all the services offered.

b/ The subscription contract also includes the provision, depending on availability, of a locker for clothing and personal belongings, although SAS BLOCBUSTER is not liable in the event of theft or disappearance of valuables deposited by the subscriber in the locker provided in the changing rooms or in the room.

c/ From time to time, the opening hours may be modified, in particular for technical or organisational reasons, depending on the needs of the room’s operation and/or activities (courses, training courses, opening of lanes, competitions, works, etc.) and certain activities may be temporarily cancelled. Except in cases of force majeure, subscribers will be informed of these events at least eight days in advance by mentioning them on the notice board at reception and on the SAS BLOCBUSTER website. The occasional modification of opening hours will not give rise to any reimbursement or compensation and the cancellation of certain activities may only give rise to a proportional reduction in the price of the subscription or an extension of the subscription for the corresponding duration and provided that it exceeds three months.

4- PRICE AND PAYMENT

a/ Payment of the subscription for the use of the room, without access to the courses, is made either in cash or in three successive monthly instalments, the first being made on the day of subscription and the other two on the same day of each of the two following months, although this second option can only be taken up after acceptance by SAS BLOCBUSTER, signature by the subscriber of the corresponding documents and payment of a sum of ten euros for administration costs.

b/ Payment for the course subscription is made in cash when the subscription only covers one of the periods defined in paragraph 2 – DURATION If it covers the three periods referred to in the same paragraph, payment may be made in three successive monthly instalments, the first of which is due on the subscription date and the other two on the same day of each of the two following months. However, this second option may only be taken up after SAS BLOCBUSTER has accepted the subscription, the subscriber has signed the proposed contracts and paid a sum of ten euros for administration costs. When the subscription to courses, whatever the frequency, is taken out when one of the three periods has begun, it is due in full.

c/ The applicable rate, the various options of which are defined in the schedule annexed to these general terms and conditions, is that in force on the day of subscription. In the event that the subscriber is registered at a rate to which he/she cannot lay claim, the situation will be rectified by payment within seven days of the difference between the price paid and the rate applicable to him.

d/ In the event of an incident or non-payment, the subscriber will be invoiced for the additional bank charges incurred.

5- CESSATION OF USE OF THE FACILITIES

If the subscriber ceases to use SAS BLOCBUSTER’s facilities permanently or temporarily, no refund or extension will be made. However, in the event of incapacity for medical reasons, preventing the subscriber from climbing, duly justified, SAS BLOCBUSTER may offer subscribers the option of suspending their subscription contract and extending it at its term for a period equal to that of their incapacity without it exceeding three months or one of the three periods of monitoring courses in paragraph 2.

6- DOCUMENTS TO BE PROVIDED

All new subscribers must prove, at the time of registration, that they have reached the age of majority or, in the case of minors, that they have parental authorisation. The subscriber must provide the documents enabling him/her to benefit from a preferential rate in accordance with the table annexed to the present general conditions. The adult subscriber will also certify that his or her state of health allows him or her to practice rock climbing and the legal guardian of the minor subscriber will certify that the latter’s state of health allows him or her to practice rock climbing.

7- LIABILITY INSURANCE

a/ SAS BLOCBUSTER is insured for damages involving its civil liability. This liability is not likely to be incurred in the event of an accident resulting from the subscriber’s failure to observe the safety instructions stipulated in the internal regulations or inappropriate use of the installations and equipment. In the event of an accident, the subscriber is required to report it immediately to SAS BLOCBUSTER, by himself or a third party representing him.

b/ The subscriber’s civil liability for damage of any kind that he/she or she may cause during the exercise of activities within the scope of his or her subscription to other subscribers or to any other person, including members and staff of SAS BLOCBUSTER, as well as to property, regardless of who owns it, must be covered by personal insurance taken out by the subscriber with the company of his or her choice guaranteeing the said damage.

8- TRANSFER AND TERMINATION

a/ The subscription, which is dematerialised, is strictly personal; it is non-transferable and non-transferable. Any breach of this principle will be followed by a notice, sent to the subscriber by registered letter with acknowledgement of receipt, of termination of the subscription contract in the event of a new irregularity. In the event of a new infringement, the contract will be automatically terminated, the subscriber will then not be entitled to a partial or total refund of the subscription price.

b/ If a payment default, of whatever kind, is not regularised within seven days or if payment incidents are repeated beyond two, the contract will be automatically terminated and the subscriber will remain liable for any sums that have not been paid.

c/ SAS BLOCBUSTER may immediately suspend or terminate the subscription contract of any subscriber who does not respect one of the clauses of the internal regulations, in particular due to behaviour that could present a risk or inconvenience for himself or for other users.

9- ADDITIONAL INFORMATION

Through SAS BLOCBUSTER, the subscriber may receive information as well as proposals from other companies or associations. If they do not wish to do so, they simply need to write to SAS BLOCBUSTER, specifying their surname, first name, address and subscription reference. In accordance with the French Data Protection Act of 1978, each subscriber has the right to access and rectify any personal data concerning him/her. It is also recalled that the subscriber has the possibility of recourse to a consumer mediator under the conditions provided for in the first title of Book VI of the French Consumer Code.

B/ FREE ENTRIES

10- DURATION

These are day tickets, valid from opening to closing time. They can be purchased for a single day or in a book of ten tickets that can be used for four years.

11- SERVICES AND TERMS OF USE OF THE ROOM

a/ The client can use the facilities of the room and benefit from all the services offered other than the courses and training courses, which are part of a particular service.

b/ Subject to availability, the customer can benefit from a locker for clothing and personal belongings, SAS BLOCBUSTER is not liable in the event of theft or disappearance of valuables that are left by the customer in the locker provided in the changing rooms or in the room.

c/ From time to time, the opening hours may be modified, in particular for technical or organisational reasons, depending on the needs of the operation and/or animation of the hall (courses, training courses, opening of lanes, competitions, works, etc.) and certain activities may be temporarily cancelled. Except in cases of force majeure, a notice informing of these events will appear at least eight days in advance on the notice board at reception and on the SAS BLOCBUSTER website. The occasional modification of opening hours will not give rise to any reimbursement or compensation and the cancellation of certain activities will not give rise to a reduction in price.

12- PRICE AND PAYMENT

The applicable rate, the various options of which are defined in the schedule annexed to these general terms and conditions, is that in force on the day of purchase of a one-day ticket or a book of ten tickets. In both cases, payment is made in cash. In the event of a payment incident, any additional bank charges incurred will be invoiced to the customer.

13- CESSATION OF USE OF THE FACILITIES

If the customer ceases to use SAS BLOCBUSTER’s facilities permanently or temporarily as a result of purchasing a booklet of ten entries, there will be no refund or extension.

14- DOCUMENTS TO BE PROVIDED

All new customers must prove, at the time of registration, that they have reached the age of majority or, in the case of minors, that they have parental authorisation. They must provide the documents enabling them to benefit from a preferential rate in accordance with the table annexed to the present general conditions. The adult client will also certify that his state of health allows him to practice rock climbing and the legal guardian of the minor client will certify that his state of health allows him to practice rock climbing.

15- LIABILITY INSURANCE

a/ SAS BLOCBUSTER is insured for damages involving its civil liability. This liability is not likely to be incurred in the event of an accident resulting from the subscriber’s failure to observe the safety instructions stipulated in the internal regulations or inappropriate use of the installations and equipment. In the event of an accident, the customer is required to report it immediately to SAS BLOCBUSTER by himself or a third party representing him.

b/ The customer’s civil liability for damage of any kind that they may cause during the performance of their activities to other customers or to any other person, including members and staff of SAS BLOCBUSTER, as well as to property, regardless of its owner, must be covered by personal insurance taken out by the customer with the company of their choice guaranteeing the said damage.

16- TRANSFER and TERMINATION

a/ The book of ten entries, dematerialised, is strictly personal; it is non-transferable and non-transferable. Any breach of this principle will be followed by a notice, sent to the client by registered letter with acknowledgement of receipt, informing him/her of the termination of the contract in the event of a new irregularity. In the event of a new infringement, the contract will be automatically terminated, the client will then be unable to claim partial or total reimbursement of the subscription price.

b/ If a payment incident is not regularised within seven days, the contract will be automatically terminated and the customer will remain liable for any sum that has not been paid.

c/ SAS BLOCBUSTER may immediately suspend or terminate the contract of any customer who does not comply with one of the clauses of the internal regulations, in particular due to behaviour that could present a risk or inconvenience for himself or for other customers.

17- ADDITIONAL INFORMATION

Through SAS BLOCBUSTER, the customer may receive information as well as proposals from other companies or associations. If the customer does not wish to receive such information, simply write to SAS BLOCBUSTER stating their surname, first name, address and subscription reference. In accordance with the French Data Protection Act of 1978, each customer has the right to access and rectify any personal data concerning them.

It is also recalled that the customer has the possibility of having recourse to a consumer mediator under the conditions provided for in the first title of Book VI of the French Consumer Code.
